Court Overturns Central Bank Decision to Place “Awal Bank” Under its Management

Bahrain Mirror: The High Administrative Court, presided over by Judge Juma'a al-Moussa, overturned a decision placing "Awal" Bank under the management of Central Bank, and canceled the decision to appoint an external director to manage it. The court imposed that the Central Bank pays the expenses of the case and the lawyers' fees.

The lawsuit was in action until it reached the Court of Cassation, which overturned the appealed ruling, and referred the case back to the court the originally issued a verdict in it.

In the details of its ruling, the court said that the legislator imposed on the Central Bank, before signing any administrative measures for the licensee, to send the latter a written notice that includes the violations of the licensee in the laws and terms of acquiring a license.

The defendant, the Center Bank of Bahrain, issued two appealed decisions to put "Awal" Bank under its management, and appoint an external director to manage it. The papers were void of proof that the defendant adopted the rules and procedures set by the legislator. Therefore, both aforementioned decisions were proved to have been issued in violation of the correct rule of law, and thus are to be canceled along with the consequences resulted.
